Our Terms & Conditions

These terms are to be read alongside and in addition to our Privacy policy and our Cookies Statement.

It is important that you (the client) read the following terms and conditions carefully before making a booking with us (Ester Heinzmann, trading as Be Inspired Tours).

By booking any of our tours you declare that you agree to these terms and conditions.

1. Our tours

1.1. Public tours = Tours which are scheduled, ticketed and bookable on our website. Tickets are sold per person and each participant requires his/her own ticket.
Number of tickets available for a public tour can vary. If you make a booking for a public tour you will be sharing this tour with other clients who likewise made a booking for the same tour.

1.2. Private Tours = Tours which are arranged and booked by mutual agreement between the client and us, by email or other means, and are exclusively available for that client.
Private tours are for a maximum of 10 people, we may agree to book additional attendees in if the client so wishes, but this would be at additional costs to the client.

2. Tickets / Bookings

2.1. Tickets and bookings are valid only for the tour, date, time and number of people specified in our booking confirmation or invoice.
2.2. Tickets must be brought to the tour and verified by the guide as the only authorised person to do so.
2.3. Our tickets are non-transferrable and in order to participate in our tour, you must be the named ticket holder.
2.4. In case of a private tour, the maximum number of attendees is specified in the invoice. No further attendees will be accepted without prior agreement and further advance payment.

3. Payment

3.1. Payments are accepted in GBP only.

3.2. Online payment
Online payments must be made by PayPal, debit or credit card. We currently use PayPal to process all online payments. You do not need to have or set up a PayPal account in order to make a payment. However, by completing a payment with PayPal you do agree to PayPal’s Terms & Conditions and Privacy policy.

3.3. Payment by direct bank transfer
Payments by direct bank transfer are due 14 days from the invoice date, or 7 days before the booked tour date, whichever date is earlier. If we do not receive your payment in time, we reserve the right to cancel your booking. In case of cancellation, we shall not be liable to you for any direct or indirect loss or damage whatsoever.
Any transaction fees are to be covered by you. We only issue electronic invoices.

3.4. Cash payment
We generally do not accept cash payments for our tours, as all bookings must be paid in advance. However, we reserve the right to agree to cash payment in circumstances we deem exceptional. This must be agreed in advance in writing and on an individual basis.

If we do agree with you to accept cash payment, you must bring the exact amount due in cash 15 minutes prior to the tour’s starting time to allow sufficient time to process the payment.

3.5. Scheduled tours
For scheduled tours we can currently only accept online payment. Section 3.2 applies.

3.6. Private tours
When you arrange a private tour with us, we will email you an electronic invoice. All payments must be made via direct bank transfer. Section 3.3 applies.

Payments are due 14 days from the invoice date, or 7 days before the booked tour date, whichever date is earlier. If we do not receive your payment in time, we reserve the right to cancel your booking. In case of cancellation, we shall not be liable to you for any direct or indirect loss or damage whatsoever.
Any transaction fees are to be covered by you. We only issue electronic invoices.

4. Cancellation and refunds

4.1. Cancellation made by the client

4.1.1. Public tours
Tickets purchased on our website for a public tour are non-refundable.

4.1.2. Private tours
If you cancel the tour within 7 days of paying the invoice, we will issue a refund of 80%, unless such cancellation is made 7 days or less prior the agreed tour date in which case no refund will be given.

If you cancel later than 7 days after the invoice was paid, no refund will be given.

If you cancel any additional attendees after the invoice has been paid – no refund will be given, regardless of when such cancellation is made.

All cancellations are to be made in writing by email or via our cancellation form.

Should any transaction fee be applicable, this will be deducted from the amount to be refunded.

4.2. No show or lateness

4.2.1. Public tour
If you have booked a public tour and do not turn up 5 minutes after the agreed meeting time at the agreed meeting place, the tour will start without you and no refund in any form will be given.

4.2.2. Private tour
If you have booked a private tour and do not turn up 30 minutes after the agreed meeting time at the agreed meeting place, the tour will be cancelled and no refund in any form will be given. If you do turn up within the first 30 minutes, we reserve the right to alter the original itinerary and finish the tour within the previously agreed timeframe. In this case no refund will be given, neither partial nor full.

4.3. Cancellation by us
We reserve the right to cancel tours in which case you will receive a full refund of the amount we received from you. No further refund or compensation will be made and we shall not be liable to you for any direct or indirect loss or damage whatsoever.

If cancellation is made by us because of you have not paid our invoice in time or because you have not met other terms in this agreement (including sections 3.3, 3.4 and 3.6), no refund will be due and no compensation will be made and we shall not be liable to you for any direct or indirect loss or damage whatsoever.

5. Copyright

5.1. We are the owner or licence holder of all content on our website, including text, design, layout, graphics, photographs, videos and you must not reproduce or use any of this material without our written permission.
5.2. We may take photographs during our tours and use them on our website, social media and other platforms for advertising purposes.
5.3. You are welcome to take photos during a tour, unless the location visited prohibits this (see section 8 “conduct”). Audio or video recording of the tour is strictly prohibited and the content of the talks remain property of Ester Heinzmann.
5.4. Any material handed out during or after the tour or event (leaflet, postcards, etc.) may not be reproduced or published in any way or form, and its content, layout, graphics and design remain property of Ester Heinzmann.

6. Information

We do not guarantee accuracy of any of the information presented during our tours, on our website, handouts, social media or any other means, and we will therefore exclude any liability for any inaccuracy or error to the fullest extent permitted by law.

The content of our tours and of our website is for entertainment and leisure purposes only.

7. Client’s personal safety and well-being

7.1. Please dress appropriately. Wear comfortable walking shoes, a jacket and carry an umbrella with you. In hot weather, please carry a bottle of water with you.
7.2. The tour will take approximately 1.5 to 2 hours (unless stated otherwise), and consist of both walking and standing. By booking our tours you confirm you are physically fit to walk and stand for the length of time specified.
Should you feel unwell during the tour, please inform the guide.
Should you have any medical conditions that might affect your participation in the tour, please inform the guide. You may consider booking a private tour, so that itinerary and pace can be tailored around your requirements.
7.3. You are required to follow the guide’s instruction, as well as of security services (e.g. police force, museum staff) with regards to safety and conduct in the places you are visiting.

8. Conduct

8.1. We reserve the right to refuse attendance to our tour, or request a client to leave, in particular if that person’s behaviour is deemed inappropriate, be it towards other participants, the guide or third parties, or affects the safety of the group or of that person themselves.
8.2. Children under the age of 16 must be accompanied by an adult.
8.3. You may not bring dogs or other pets to the tour.
8.4. You are required to follow the code of conduct of the places visited. In some places, photography may not be allowed, or food and drink may only be consumed in designated areas. You are required to abide by those rules and follow the guide’s or the staff’s instructions.
8.5. Please note many places such as museums restrict entry with luggage. Bags larger than a regular size handbag or small backpack may not be brought inside. Should you be travelling with wheeled cases or larger items of luggage on the day of the tour, you are required to make your own storage arrangements prior to the tour’s starting time. If you are denied entry by a third party, we will not accept liability and we will not refund your ticket (see also section 10).

9. Damage / Loss / Injury

9.1. We do not exclude or restrict liability for death or personal injury resulting from our own negligence.
9.2. Any other liability resulting from negligence on our part will be restricted to the refund of the ticket price.
9.3. You are required to maintain your own safety during the tour (e.g. when crossing the street or walking stairs), and are responsible for your belongings at all times.
9.4. We do not accept any responsibility for items lost or stolen during our tours, or for any consequential loss, delay, damage or inconvenience.
9.5. We are not responsible for any damage to third parties arising from our clients’ negligence or non-compliance with the guide’s or staff’s instructions or a local code of conduct.

10. Third party

We are not responsible for third parties’ acts or omissions and do not accept any liability. Please contact the third party directly for any claims you may have towards them.
This includes denied access to museums and other places due to third party rules and requirements.

11. Changes to itinerary

Our tours are conducted in public areas and may therefore be subject to possible disruptions by third parties. The route/itinerary of our tours as described on our website or elsewhere may vary and changes to the original itinerary are possible.
A museum for example might close certain galleries temporarily and without or only at short notice, which may affect the original itinerary of the tour. Short notice/no notice road closures by security forces are likewise possible.
11.1. In case of minor disruptions, we will choose an alternative route/itinerary with equally relevant content, but as this is outside of our hands, we reserve the right to choose not refunding you.
11.2. Should the disruption or change to the itinerary be so substantial that the tour cannot proceed as planned, the guide may offer an alternative route/itinerary. Should you disagree with the alternative route/itinerary and decide to end or leave the tour, a partial refund may be given based on the progress of the tour already made.

12. Force majeure

Acts of God, terrorism, industrial action, and other unforeseen circumstances may affect the tour and could lead to a cancellation of the tour entirely. In this case we reserve the right not to issue a refund.

13. Privacy

By agreeing to these Terms & Conditions you also agree to our Privacy policy (please follow the link).

14. Client warranty

14.1. By agreeing to our terms and conditions, you confirm that you are over 18 years of age and authorised to enter into this contract. You further confirm that all details submitted for the booking are true and correct.
14.2. The booking and participation in our tours is for private purposes only.
14.3. If you are in breach of any of our terms and conditions, we reserve the right to cancel any further bookings you have made with us or will make with us. We shall not be liable to you for any direct or indirect loss or damage whatsoever, arising from that cancellation.

15. Linking our website

15.1. Any link on a third party website to our website does not mean an endorsement by us.
15.2. We may feature other organisations, activities and individuals during our tours, on our website, social media pages and other. Featuring does not mean we endorse those third parties, their views or activities, and we are not liable for any claims you may have towards them, past, present and future.
Featuring does not mean we advise to engage, participate, visit, or enter into a relationship of any kind with those activities or organisations.
15.3. Our website contains links to third party websites, either by us or e.g. by a third party advertisement provider. This includes links to PayPal, our payment gateway provider and links to our social media pages.

By following those links you declare that you do so at your own discretion and at your own risk.

We shall not be responsible or liable for the privacy policies of such websites, the content of such websites, nor for any damage, loss or offence caused or alleged to be caused by any content on such websites.

16. Prices

16.1. Prices are subject to change. We reserve the right to alter prices temporarily (e.g. during a promotional period) or permanently. Any bookings already made will not be affected by those alterations, and no reimbursements will be made in case the booked tour will later on be offered for a reduced price, e.g. as part of a promotion.
16.2. Currently our prices are stated without VAT, and VAT is not applicable.

17. Coupons

Promotional coupons are valid only for the time during the promotion, which is specified on the coupon itself or in the advert which features the promotional code.

18. Terms of Use

This concerns the exclusion or limit of our legal liability in connection with your use of this website.

We accept no liability whatsoever arising out of the use of or access to this website including any errors contained in this website or if the website is unavailable and we shall not be liable for any direct or indirect losses whatsoever.

You access and use this website at your own risk and we do not warrant that the use of this website or any material downloaded from it will not cause damage to any property, including but not limited to loss of data, computer virus infection, spyware, malicious software, trojans and worms.

Furthermore, we accept no liability in respect of losses or damages arising out of changes made to the contents of this website by unauthorised third parties.

This website may contain links to third party websites, which you may choose to follow at your own discretion and your own risk. By doing so, you agree that we are not responsible for the availability of such sites, or those sites’ safety.

19. Governing law and Jurisdiction

This agreement is governed by the law of England and Wales, and is subject to the exclusive jurisdiction of the courts of England and Wales.

20. Validity

In the event that any clause listed in this agreement becomes illegal at any point in time, the remaining clauses will remain binding.
